RISK AGREEMENT TERMS OF USE AND USER AGREEMENT ("Agreement") ACCEPTANCE OF TERMS THROUGH USE By using this site or by clicking "I agree" to this Agreement, you ("User") signify your agreement to these terms and conditions. LICENSE TO USE THIS SITE Upon acceptance of this Agreement, the Company grants you a non-exclusive, non-transferable, limited license to use this site strictly in accordance with this Agreement and the instructions provided on the site. You agree not to make false or fraudulent statements to gain access to or use this site. All content and services on this site are the property of the Company, its advertisers, or licensors and are protected by applicable intellectual property laws. All rights not expressly granted are reserved. You agree to pay for all purchases and services made using your name or payment method and agree not to dispute such charges except as permitted by law. You are responsible for all collection costs and attorney’s fees arising from non-payment. These communications may include registration confirmations, receipts, scheduling updates, event notices, hotel or travel information, and other transactional or administrative messages related to the event. Message and data rates may apply depending on your mobile carrier and plan. You may opt out of SMS messages at any time by following the opt-out instructions in the message (such as replying STOP) or by contacting the Company. Opting out of SMS does not affect required transactional or administrative communications. You represent that all contact information provided is accurate and that you are authorized to consent to communications at the email address and phone number provided. LICENSE RESTRICTIONS Use: You agree not to copy, reproduce, distribute, sell, modify, publish, transmit, or create derivative works from any content, code, or materials on this site except as expressly permitted. Systematic data retrieval or compilation without written permission is prohibited. Security: You agree to protect your login credentials, keep them confidential, and notify the Company immediately of any unauthorized access. You agree not to reverse engineer, decompile, or otherwise tamper with any software or materials on this site. Export Controls: You agree to comply with all applicable export and import laws and regulations and not to export or re-export any materials in violation of such laws. Government Use: Software provided to U.S. Government entities is provided with Restricted Rights under applicable federal regulations. CHOICE OF LAW AND FORUM This Agreement is governed by the laws of the State of West Virginia. Any legal action must be brought exclusively in the courts of Raleigh County, West Virginia, and proceedings shall be conducted in English. CALIFORNIA USER RIGHTS California residents may file complaints with the California Department of Consumer Affairs at 400 R Street, Suite 1080, Sacramento, CA 95814, or by phone at 800-952-5210. MISCELLANEOUS This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements. If any provision is held unenforceable, the remaining provisions shall remain in effect. You may not assign this Agreement without written consent from the Company. ATTORNEYS’ FEES In any legal action arising from this Agreement, the prevailing party is entitled to recover reasonable attorney’s fees and costs. REFUND POLICY All tournament registrations are final. No refunds are provided. Refund requests will be forwarded to the event promoter, who bears sole responsibility for any approved refunds. Registration changes may be permitted, but any resulting credit is non-refundable. USER CONDUCT You agree not to post or transmit content that is unlawful, abusive, defamatory, obscene, fraudulent, discriminatory, infringing, or harmful. You may not send unsolicited communications, collect user data for improper purposes, or impersonate others. The Company may remove content at its discretion and suspend or terminate accounts for violations. This Agreement and related rules may be updated at any time. END OF AGREEMENT

TERMS OF USE AND USER AGREEMENT (“Agreement”) “Tournament In A Box” provides this notification service for informational purposes only and makes every effort to post accurate and reliable information. “Tournament In A Box” makes no warranties, guarantees, or representations of any kind as to the content, accuracy, or completeness of the information contained in or disseminated through the notification service or any related services. The User understands that when subscribing to this notification service, “Tournament In A Box” cannot guarantee 100 percent delivery of any message in a timely manner. “Tournament In A Box” utilizes third-party infrastructure to deliver messages such as text messages (SMS) and voice calls, which may be unavailable due to issues beyond its control, including congestion, weather, power outages, acts of terrorism, or other unforeseen events. Furthermore, this notification service is dependent upon external providers such as your telephone carrier, wireless carrier, or email delivery service, as well as the proper functioning of your own equipment, including your telephone, mobile phone, or PBX system. “Tournament In A Box” will make every effort to ensure delivery of messages; however, due to the dependencies and circumstances described above, it cannot guarantee that any message will be delivered or received in a timely manner, or at all. Service costs, including phone usage and text message charges imposed by your carrier, are your responsibility. DISCLAIMER OF WARRANTIES THE SERVICES, INFORMATION, AND DATA MADE AVAILABLE THROUGH THIS SERVICE ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. “TOURNAMENT IN A BOX,” ITS AUTHORIZED AGENTS, AND CONTRACTORS MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE CONDITION, FUNCTIONALITY, OR SUITABILITY OF THIS SERVICE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. LIMITATION OF LIABILITY “Tournament In A Box,” its authorized agents, and contractors shall not be liable for any loss or injury caused, in whole or in part, by their actions, omissions, or contingencies beyond their control, including errors or omissions in procuring, compiling, or delivering information, or for any reliance placed on information provided through this service. IN NO EVENT SHALL “TOURNAMENT IN A BOX,” ITS AUTHORIZED AGENTS, OR CONTRACTORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOST REVENUES OR LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH THE USE OR MISUSE OF THIS SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Text Message Notifications While SMS text messaging may be included in certain “Tournament In A Box” hosted tournaments, standard carrier charges for landline and mobile services may still apply. When an alert occurs, “Tournament In A Box” will send an SMS message to the designated number. If the recipient does not wish to receive SMS messages, they may send the keyword “STOP” at any time to cancel the SMS portion of the service. For questions during an SMS session, users may email info@tournamentinabox.com for assistance. If you have opted into SMS service, notifications will be delivered via SMS to the accepted mobile number at a rate of one or more messages per qualified event. This service is not a substitute for reviewing posted tournament materials, including schedules and staging times. Users are responsible for making reasonable efforts to review and comply with posted information. The SMS system is for outgoing messages only. Do not reply to received texts. For questions regarding messages, contact the tournament promoter directly. Opting out of SMS does not affect your ability to receive required transactional or administrative communications related to your registration. You represent that the contact information you provide is accurate and that you are authorized to consent to receive communications at the email address and phone number provided. By selecting the “I Accept” box, you acknowledge that you understand and agree to the terms above and are explicitly opting in to the “Tournament In A Box” and partner notification service.
